PROPERTY

The subject of this Agreement is a house located in Prince Edward County, Ontario (the “Property”). The Owner agrees to lease the Property to the Guests. The maximum number of Guests allowed to occupy the Property is eight (8) and the maximum number of cars is four (4).

TERM

The term of the lease under this Agreement begins at 4:00 PM on the check-in date selected at purchase and ends at 10:00 AM on the check-out date selected at purchase. This period shall be referred to as the “Term”.

PAYMENT

Guests agree to pay the rental fee stated at the time of purchase through The Canada House website, (thecanadahouse.com), to use the Property for the Term. Payment of the rental fee shall be made as follows: A “Reservation Deposit” of 50% of the rental fee and applicable tax is due at the time of booking the Reservation; The “Remaining Balance” and tax, security deposit of $500.00 is due prior to the Reservation date. If the entire fee is not paid in full prior to check-in Guests shall not be permitted to move into the Property. All payments must be made online at thecanadahouse.com.

CANCELLATION POLICY

Reservation deposits are non-refundable. If Guests should cancel, the deposit may be used towards a future booking / term. It is the responsibility of the Guests to arrange a new booking / term with the assistance of the Owner.

SECURITY DEPOSIT

A security deposit of $500.00 is collected with the “Remaining Balance”, and shall be returned to the Guests at the with 7 business days of the end of the Term, if the Property is returned to Owner in the same condition as at the beginning of the Term, less normal wear and tear.

CONDITION OF THE PROPERTY

Guests are asked, for their protection, to call to the attention of the Owner any defective conditions that exist at the time of check-in so that they can be documented and/or repaired as needed. Guests shall occupy the Property personally and no other persons shall occupy the Property unless otherwise specifically agreed in writing. Guests agree to take very good care of the Property including appliances and furnishings and maintain them in clean and sanitary condition. No alterations will be made without the express written permission of the Owner. Guests agree that they are responsible for any loss and damage to rental property or contents thereof due to their negligence, carelessness, or intentional conduct. Upon check-out, Property shall be left clean and clear of all personal belongings with all trash organized as per the House Guide. The Property shall include bedding such as blankets, pillows, sheets and bath towels and linens.

PETS, NOISE, SMOKING AND PARKING

No pets of any kind are permitted in or around the Property. The Guests agree not to allow on the Property any excessive noise or other activity that disturbs the peace and quiet of the neighbours. This is a NON SMOKING Property and Guests agree to not allow smoking IN or ON the Property. Any violation of this provision will be grounds for immediate termination of this Agreement and will also subject the Guests to liquidated damages obligation in an amount equal to the security deposit plus the entire fee. Guests shall only park in the driveway. No RVs, trolleys, tents or tent trailers are permitted on the Property. Please note, there are area restrictions regarding wedding activities such as a party(ies), on the property, therefore, any such party(ies) are not allowed on the Property or any other activities that would be defined as a ‘party’ with outside guests.

UTILITIES

The rental fee includes heat, electricity, water and sewer. Guests agree to moderate and be respectful of these services and mindful that the property is serviced by a septic system; therefore, only toilet paper is allowed to be dispensed through the toilet.

EMERGENCIES, RIGHT OF ENTRY AND SHOWINGS

In case of emergency Guests shall contact Owner as soon as possible. Owner shall have the right to enter the Property during the Term without permission of the Guests when emergency circumstances exist, or when an obvious breach of this Agreement exists. If Owner reuqies to visit the property during the Guests Term, Owner shall give Guests reasonable notice of any such visit.

INDEMNIFICATION

Guests hereby agree to indemnify and hold harmless Owner, its and their principals, agents attorneys, insurers, employees, servants, representatives, successors and assigns of any and all of them, from and against loss, claim, damage, demand, suit or judgment or liabilities that they may incur and expenses to which they may be put, including reasonable attorney’s fees, arising from any claim for injury or death to persons, or damage to property or any claim on account thereof resulting from the use of the Property by Guests, their guests or invitees.

ONTARIO LAW APPLIES; SEVERABILITY

Both Guests and Owner agree that the substantive law of the Province of Ontario applies to the interpretation and application of this Agreement. In addition, both Guests and Owner agree the courts of the Province of Ontario, shall have sole and exclusive jurisdiction and venue for any dispute arising under this agreement. If any provision of this Agreement is determined to be invalid or unenforceable under law. It shall not affect the enforceability of any other provision of this Agreement.
